Judge in day-care rapist case reported

The judge in the trial of the day-care rapist case has been reported to the Swedish National Investigation Department for allowing a camera in court to record the accused man's abuse tapes. He has branded the decision as 'absurd.'

On the last day of the trail in of the 21-year-old nursery intern a number of pictures and videos taken by the man were played back in court as evidence, at the court in Kalmar, southern Sweden.  

Judge Lars Annerén gave the order for the district court's camera to be directed at the screen, so that the evidence would be recorded.

An expert from the Swedish National Investigation Department (Rikskriminalen), who had previously examined the tapes, was critical of the decision saying that because of the nature of the material it should not be recorded or shared.

As a result the department reported the judge to the Swedish National Police Board (Rikspolisstyrelsen) for an internal investigation. He is being investigated for aggravated child pornography crimes. 

The judge blasted the decision saying that the district court needs a copy of the material in order to reach an accurate assessment of the crimes committed.

"It is totally absurd that the court cannot take part, it is standard practice that you file the materials for the court. I have never ever heard of anything similar," Annerén told the Aftonbladet newspaper which broke the story.

He added to the TT news agency that he was considering handing the case over to another judge as a result of the incident.

"I have to consider whether I will continue on the case in my role as an impartial judge. It is not some nutter that has given the notification but it has been done by the police's internal investigation department. Then it may seem strange if I continue to handle the case," he said.

The 21-year-old man charged with aggravated sex crimes against children at a daycare has already confessed to the charges, and called his internship there a "golden opportunity."

Police confiscated just under 600 pictures and over 200 films from the man's computer. Around half of the images and films were deemed to be aggravated instances of child porn.
